The battle over content governance on the Internet is heating up. Building on the step taken by Facebook with its creation of the Oversight Board, I propose a “grand bargain” for multi-stakeholder governance between platform companies and liberal democracies. This bargain would expand and formalize the role of the Oversight Board and establish a governance regime with international legitimacy, enforcement authority, and normative potential. Without such a bargain, regulation will increasingly fragment the global Internet. Platform companies will be embroiled in legal battles across the world as they twist their platforms and processes to meet a patchwork of regulatory and legal requirements. Authoritarian regimes will be further empowered to crack down on freedom of speech and expression. Liberal democracies will have missed a crucial opportunity to advance a normative free speech agenda aligned with democratic principles.
