Abstract: Submitted in partial fulfillment of the degree of Master of Arts in Law and Diplomacy at the Fletcher School of Law and Diplomacy. Abstract: This paper identifies the trade policy measures available to countries to protect domestically high farm animal welfare standards and assesses their legality under current WTO law. The array of available policy measures includes: labeling, differential tariffs and taxes, import bans and other quantitative restrictions, green box measures, and special and differential treatment. In light of the Appellate Body jurisprudence to date on the SPS and TBT Agreements and on GATT Articles III, XI, and XX, the optimal policy basket of measures is a combination of labeling, tariffs, green box measures, special and differential treatment, and coordination with the OIE Terrestrial Animal Health Code.
